Clayton grew up in Sugar land, Texas. He graduated from Texas State University in 2007, and earned his J.D. from South Texas College of Law in 2010.

Clayton focuses his practice on advising oil and gas operators with all aspects of their upstream operations, with emphasis on leasing, acquisition issues, and title.  Over the years, Clayton has developed a reputation for his ability to find solutions which meet the needs of both the legal and business-minded.  As a result, he has become a trusted advisor to identify practical, efficient, and inexpensive fixes for operators’ everyday problems.

Prior to forming Wheat & Wittpenn, Clayton partnered or worked for three nationally-recognized oil and gas firms in Houston, and also worked as a field landman in the Uintah Basin and Eagle Ford Shale. Clayton is licensed to practice law in Texas (Oil, Gas, and Energy Resources Section) and North Dakota (Real Property, Trusts, and Probate Section), and is a member of the Sons of the Republic of Texas; Houston Producer’s Forum; West Houston Area Association of Petroleum Landmen; Young Professionals in Energy; and the Texas Young Lawyer’s Association.

Brian T. Wittpenn is an experienced oil and gas and real estate attorney who works hard and smart for his clients.

For his oil and gas clients, he renders title opinions, conducts due diligence during mergers and acquisitions, and works directly with landmen and brokers to keep the project on schedule. Brian also represents Title Insurance Companies with curing title issues using negotiation and litigation in order to obtain the quickest and most efficient results for his clients. Brian also assists major oil and gas drilling companies with filing liens and securing payment for unpaid services they have rendered.

Brian received his B.A. from The University of Texas at Arlington with dual majors in English and Philosophy, cum laude, his M.A. in Philosophy from The University of Houston, and his Doctor of Jurisprudence from the University of Houston Law Center. During law school, he was an Editor for the Rocky Mountain Mineral Law Foundation Journal and was Most Contributing Editor as a Senior Articles Editor on the Houston Journal of International Law.

Brian was awarded 2019 Rising Star Super Lawyer. Less than 2.5% of practicing attorneys are awarded this distinction.

Brian is a member of the State Bar of Texas, including the Oil, Gas, and Energy Resources Section.
